This Privacy Notice describes how Hyperscale Systems, Inc. ("Hyperscale," "we," "us," or "our") collects, uses, shares, and protects personal information when you (1) visit our website (runhyperscale.com), (2) engage our AI-powered call-answering and dispatch services, or (3) otherwise communicate with us (collectively, "Services"). It also explains your rights and choices regarding your information.
1. Information We Collect
a. Information You Provide Directly
- Contact & Account Details: name, email, phone number, company name, job title, mailing address, and any preferences or notes you submit when you request a demo, create an account, or otherwise communicate with us.
- Call Transcripts & Dispatch Messages: driver names, contact numbers, load details, and other identifiers conveyed during recorded calls or dispatch notifications. These may include sensitive business information.
- Payment & Billing Information: billing address, payment method details (processed by third-party payment processors), and transaction history if you purchase professional services.
b. Information Collected Automatically
- Usage Data: pages visited, features accessed, date/time stamps, referring URLs, and other analytics collected via cookies or similar technologies.
- Device & Log Data: IP address, browser type/version, operating system, device identifiers, and telemetry data.
- Location Data: approximate location based on IP address unless you choose to share more precise location.
c. Information from Third Parties
- Service-Provider Data: aggregated or de-identified analytics from providers (e.g., web analytics services).
- Integration Data: metadata from TMS, telephony, or scheduling systems when you authorize Hyperscale to integrate (e.g., call volume statistics).
- Connected Google Account Data: when you connect Gmail or Google Calendar to Vic, the email messages, labels, drafts, calendar list, calendar events, and free/busy availability that you ask Vic to work with. See Section 4.
2. How We Use Your Information
- Provide & Optimize Our Services:
Configure, deploy, and maintain our AI-powered call-answering and dispatch workflows integrated with your systems. Analyze call recordings to evaluate, validate, and continuously improve our Services, with short-term retention of sensitive details for those purposes. This never includes data received from Google APIs. - Communicate with You:
Respond to support requests, inquiries, or feedback. Send operational messages (e.g., service updates, maintenance notices, policy changes). Provide optional marketing or educational content if you opt in. - Business Operations & Compliance:
Perform internal analytics and reporting (e.g., usage trends, ROI analysis). - Legal & Security Obligations:
Detect, investigate, or prevent fraud, security incidents, and other prohibited activities. Comply with subpoenas, court orders, or regulatory requests.
3. How We Share Information
We do not sell or rent personal information. We share data only as follows:
1. Service Providers & Contractors
- Categories: hosting providers, analytics platforms, CRM and email tools, payment processors, and professional services (e.g., legal, accounting)
- AI Model Providers: Anthropic (Claude API), OpenAI (API Platform), and Amazon Web Services (Amazon Bedrock) generate Vic's responses. Langfuse stores request traces for debugging. Each processes data only to provide the Services and is contractually prohibited from training models on it.
2. Integration & Implementation Partners
When you authorize a TMS, we share minimal necessary metadata and call recordings to enable configuration and troubleshooting.
3. Affiliates & Business Transfers
In connection with a merger, acquisition, sale, or financing event involving Hyperscale, provided the successor entity agrees to uphold this Privacy Notice.
4. Legal & Safety Requirements
To comply with legal processes (e.g., subpoenas, court orders). To protect against imminent threats to anyone's safety or property or to investigate fraud, security breaches, or other unlawful activity.
4. Google User Data
Hyperscale's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. The use of raw or derived user data received from Workspace APIs will adhere to the Google User Data Policy, including the Limited Use requirements.
When you connect Gmail or Google Calendar to Vic, we access your email messages, labels, drafts, calendar list, calendar events, and free/busy availability only to provide the features you ask Vic to perform: searching and reading your email, organizing your inbox, drafting and sending email on your behalf, and reading, creating, updating, and responding to calendar events.
We do not use Google user data to develop, improve, or train generalized artificial intelligence or machine learning models. Google user data is processed by the AI model providers listed in Section 3 solely to generate the response you requested, under terms that prohibit those providers from training on it.
We do not sell Google user data or use it for advertising. Humans at Hyperscale read Google user data only with your explicit consent, when needed for security or abuse investigation, or to comply with applicable law. You can disconnect Gmail or Google Calendar at any time from your profile settings, which revokes our access at Google.
5. How We Protect & Store Information
- Technical Safeguards: firewalls, intrusion detection, multi-factor authentication, regular penetration tests, and vulnerability scans.
- Administrative Safeguards: employee training on data privacy, formal incident response plan, SOC 2 compliance in progress, and quarterly compliance audits.
- Data Retention:
- Account & Support Data: retained while your account is active, plus a five-year backup period unless you request earlier deletion.
- Usage Logs & Analytics: retained for up to 24 months to support performance tuning, troubleshooting, and compliance, then aggregated or deleted.
Breach Notification: In the event of a data breach, we will notify affected clients and individuals as soon as reasonably practicable in compliance with HIPAA rules and applicable state breach notification laws.
6. Your Privacy Choices
- Access, Correction & Deletion:
You may view, update, or delete your account/profile data at any time by logging into your Hyperscale dashboard or contacting privacy@runhyperscale.com. - Marketing Opt-Out:
To stop receiving promotional emails, click "unsubscribe" at the bottom of any marketing email or email privacy@runhyperscale.com with subject "Unsubscribe." - Cookies & Tracking Technologies:
Most browsers allow you to block or delete cookies. Disabling cookies may limit functionality (e.g., staying logged in, some site features). To opt out of analytics tracking, install the opt-out browser add-on for the relevant analytics provider (e.g., Google Analytics). - Californians (CCPA/CPRA):
You have the right to request access to, deletion of, or portability of your personal information. To exercise these rights, email privacy@runhyperscale.com. We do not sell personal information.
7. Children's Information
Our Services are not directed at children under 16. We do not knowingly collect personal information from minors. If you believe we inadvertently collected data from a minor, contact privacy@runhyperscale.com to request deletion.
8. Updates to This Privacy Notice
We may update this Notice to reflect changes in our practices or legal requirements. The "Last updated" date at the top indicates when this Notice was last revised. We will post any updated Notice on runhyperscale.com. If we make material changes, we will notify you (e.g., email) at least 30 days before they take effect.
